Terms for manufacturers

1. Who this applies to

Water&Wind is an independent comparison site for new boats and engines, run by Water & Wind B.V.
These terms apply to boatbuilders, importers and engine manufacturers (together: manufacturers) whose brands or models appear on Water&Wind, and to anyone who supplies us with data, price lists or images.

Brands and models appear on Water&Wind based on our own research and public sources. No sign-up or agreement is needed.
A listing is free and without obligation. It does not give you any rights: not to a listing, not to a particular form or position, and not to continuation. We decide which brands and models we show and how.
Brand names and logos remain the property of their owner. We only use them to refer to the brand and its models.

Rankings, comparisons, filters and sorting cannot be bought. There are no hidden arrangements or obligations.
We do not change data, assessments or order in exchange for payment, cooperation or supplied material.
If Water&Wind offers paid visibility in the future, it is always labelled as Promotion and kept separate from rankings and comparisons. Separate arrangements are made in advance.

Specifications and prices come from manufacturers, importers, dealers and public sources. For each value we record where it comes from and when we recorded it.
You can supply corrections, price lists and specifications, preferably with the source (for example a price list or brochure). We process them after checking. We make a correction because it is right, not because it is requested.
Use of material available online and supplied: what a manufacturer promotes or supplies itself, we may show, enrich and translate.
If you do not publish a price, we may show a new-price indication, always marked as an indication and with its source.

Photos and videos of boats and engines come from manufacturers and their importers. We use them to show your brand and models, to promote those brands. Copyright remains with the owner; we claim no rights to them.
If you supply images yourself, you allow us to show them free of charge and non-exclusively with your brand and models on Water&Wind and in our communications about those models.
If you do not want an image on Water&Wind, submit a removal request. We respond within a week.

Dealers sign up themselves. Per brand we check whether a dealer is an official dealer, for example using your dealer list. Sometimes we ask you to confirm.
If a company is not (or no longer) an official dealer of your brand, let us know. We then remove the brand from that dealer.
Dealers are listed by distance or alphabetically. A higher position cannot be bought there either.

With your models we link to your website. Arrangements about purchase, delivery and warranty are made between the visitor and you or your dealer; we are not a party to them.
We count visits to your brand and model pages and clicks to your website, without personal data. We may send you these figures periodically. This is a service, not a commitment.

We collect data carefully, but cannot guarantee that everything is always complete and up to date. You are responsible for data and images you supply yourself.
For a free listing we are not liable, including for lost revenue if data is (temporarily) incorrect or not visible. Report an error and we will correct it as soon as possible.

We may change these terms. The current version is always on this page, with the date of the last change.

These terms are governed by Dutch law. If we cannot resolve a dispute together, the competent court in the Netherlands decides.
